Appeals

So, you lost at the trial court level, now what?  Even if you win at the trial level, there may be parts of an order or judgment that you do not agree with, so what do you do now?

You have a few options: 

(1) do nothing, 

(2) file a motion for rehearing 

(2) file a motion to vacate the judgment under Rule 1.540 or 

(4) file an appeal.  

Should you choose to file an appeal, the Florida rules of appellate procedure are complicated.  Strict compliance is required.  If you miss the 30-day deadline to file the appeal, you are forever barred.  It is not recommended that you file your appeal with qualified and experienced appellate counsel.   An appeal may be your last bite at the apple, so you should confident in your choice of legal counsel when you decide to move forward with your appeal.

The Florida appellate rules of procedure are very different than that of the Florida Rules of Civil Procedure that govern at the trial level.

When you file an appeal – you are not asking a judge or a jury to find a defendant liable for damages you suffered or to give you something you want.  Rather, you are asking the appellate court, which consists of a three judge panel, to review what the trial court ruled and made a determination as to whether the trial court committed an error in its ruling.  As a result, if your case is on appeal, you need an attorney who understands the appeals process intimately and has a track record of achieving success in the appellate arena.
